These Terms of Service (“Terms”) govern your use of the Passion Assets website (passionassets.vip) and your purchase of products from us. By placing an order or using our website, you confirm that you have read, understood, and agreed to these Terms in full.

1. Eligibility

By using this website you confirm that you are at least 18 years old, or that you are using the site with the consent of a parent or guardian. We sell and ship to UK addresses only unless otherwise stated at checkout.

2. Products

We sell three categories of Pokemon TCG product:

  • Singles — Individual cards described and graded by condition (Near Mint, Lightly Played, etc.) in line with standard TCG industry criteria. We grade to the best of our ability; minor subjective differences in grading may occur.
  • Sealed Product — Factory sealed booster packs, Elite Trainer Boxes, tins, and collection boxes. All sealed items are sourced from authorised UK distributors. We cannot guarantee pull rates or the contents of any sealed product — this is determined entirely by The Pokemon Company.
  • Graded Cards — Cards professionally graded and slabbed by third-party grading companies including PSA, BGS, and CGC. The grade on the slab is awarded by the grading company and is not determined by Passion Assets. We are not responsible for any reassessment of grades by other parties.

We make every effort to describe and photograph products accurately. Slight variations in colour between photographs and physical items may occur due to screen calibration.

3. Pricing and Payment

All prices are displayed in GBP (British Pounds Sterling) and include VAT where applicable. We reserve the right to amend prices at any time. The price shown at the point of your order confirmation is the price you will pay. Accepted payment methods are displayed at checkout. Full payment is required before an order is dispatched.

We reserve the right to cancel and refund an order if a pricing error has occurred on our website. We will notify you promptly if this is the case.

4. Orders and Contract

Placing an order constitutes an offer to purchase. A binding contract is formed when we send you an order confirmation email. We reserve the right to decline any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability. If we decline your order after payment has been taken, a full refund will be issued within 5 business days.

5. Cancellations

You may cancel your order within 24 hours of placing it, provided it has not already been dispatched. To cancel, email us at sales@passionassets.vip with your order number as soon as possible. Once an order has been dispatched it cannot be cancelled — please refer to our returns policy below.

6. Dispatch and Delivery

We aim to dispatch all in-stock orders within 1–3 business days. Delivery estimates are provided by our courier partners and are not guaranteed. We use tracked delivery services as standard.

  • We are not liable for delays caused by Royal Mail, courier services, or circumstances outside our control (including adverse weather, industrial action, or customs delays).
  • Risk of loss passes to you upon delivery. Once a parcel is marked as delivered by the carrier, responsibility passes to you. If you believe a parcel has been lost in transit (not yet delivered), please contact us within 14 days of the expected delivery date and we will raise an investigation with the carrier.
  • We are not responsible for parcels delivered to an incorrect address provided by the customer.

7. Returns and Refunds

You have the right to return goods within 14 days of receipt under the Consumer Contracts Regulations 2013, provided the item is in its original condition. To initiate a return, contact us at sales@passionassets.vip with your order number and reason for return.

Please note the following exceptions:

  • Sealed product that has been opened cannot be returned unless it is faulty or was incorrectly sent, as opening constitutes use of the product.
  • Graded cards are sold as described by the grading company. We do not accept returns on the basis of disagreement with the grade awarded by the grading company (PSA, BGS, CGC, etc.).
  • Singles are graded to industry-standard criteria. We will accept returns where a card has been materially misdescribed.

Return postage costs are your responsibility unless the item is faulty, damaged in transit, or incorrectly sent. We recommend using a tracked service as we cannot be held responsible for returns lost in the post. Refunds will be issued to the original payment method within 14 days of receiving the returned item.

8. Faulty or Incorrect Items

If you receive a faulty, damaged, or incorrect item, please contact us at sales@passionassets.vip within 48 hours of delivery, including your order number and clear photographs of the issue. We will arrange a replacement or full refund at our discretion and cover any return postage costs where applicable.

9. Authenticity Guarantee

All cards sold by Passion Assets are sourced from reputable UK suppliers and distributors. We do not knowingly stock, sell, or knowingly supply counterfeit, proxy, or reproduction cards. If you believe you have received a counterfeit item, please contact us immediately at sales@passionassets.vip. We take authenticity issues extremely seriously and will investigate all such reports promptly.

10. Pre-Orders

Where pre-order products are offered, payment is taken at the time of ordering. Pre-order release and dispatch dates are estimates provided by our suppliers and are subject to change. We will notify you of any significant delays. Pre-orders may be cancelled for a full refund at any point before dispatch by contacting us at sales@passionassets.vip.

11. Stock and Availability

All products are subject to availability. In the unlikely event that a product becomes unavailable after your order is placed, we will contact you to offer a substitute or full refund. We do not guarantee that any product will remain in stock or be restocked.

12. Intellectual Property

All content on this website, including text, images, logos, and branding, is the property of Passion Assets Ltd or used under licence. Pokemon and all related trademarks, characters, and imagery are the property of The Pokemon Company International, Nintendo, and Game Freak. Passion Assets is not affiliated with, endorsed by, or sponsored by The Pokemon Company International or Nintendo. You may not reproduce, distribute, or use any of our original content without prior written consent.

13. Website Use

You agree not to use this website for any unlawful purpose, to disrupt its functionality, to attempt to gain unauthorised access to any part of it, or to engage in any fraudulent activity. We reserve the right to restrict access to the website at our discretion.

14. Limitation of Liability

To the fullest extent permitted by law, our liability to you in connection with any order or use of this website is limited to the value of the order in question. We are not liable for any indirect, consequential, or special losses. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

15. Your Statutory Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Changes to These Terms

We reserve the right to update these Terms at any time. The version in force at the time of your order applies to that transaction. We recommend checking this page periodically for updates.
